Nesta terça-feira (25), a Comissão de Assuntos Econômicos (CAE) aprovou o projeto de lei complementar (PLP) 202/21 que flexibiliza as regras de atuação das empresas simples de crédito (ESCs).

Sobre essas empresas, elas são autorizadas a emprestar dinheiro para microempreendedores individuais (MEIs), microempresas (MEs) e empresas de pequeno porte (EPPs).

Esse projeto apresenta diversas mudanças na Lei Complementar 167 que define as regras para as empresas simples de crédito que, segundo as normas atuais, uma ESC só pode atuar no município em que está situada e só pode usar recursos próprios.

A proposta, ainda, elimina duas restrições:

Autorização de abertura de filiais dentro do mesmo estado;Inclusão de produtores rurais e profissionais liberais no público que pode ser atendido por elas.

A partir do PLP, as ESCs poderá usar linhas de crédito bancárias com limite de alavancagem de até uma vez e meia o capital feito, além de serem autorizadas a atuar como agentes repassadores ou intermediários de recursos de programas, ou até mesmo fundos governamentais e de bancos, seja público ou privado.

Outro ponto que o texto também prevê é a captação de recursos, permitindo às ESCs fazer a cessão da carteira de crédito, ou seja, poderão transferir para outras instituições empréstimos que tiveram a receber em troca de dinheiro.

O projeto também pretende ampliar o limite de operações das ESCs ao estabelecer que passará a ser um patrimônio líquido, deixando de lado o capital realizado, conforme define a lei atualmente.

Com relação a movimentação de valores entre empresa e tomador de empréstimo, na prática, ela deve acontecer através do Sistema de Pagamento Brasileiro, por meio da transferência entre contas de titulares das duas partes e, caso isso não se cumpra, haverá uma punição de até quatro anos de reclusão.
