O Projeto de Lei 2837/23, atualmente sob análise na Câmara dos Deputados, visa alterar a Lei Maria da Penha para garantir o direito ao trabalho remoto a mulheres que enfrentam situações de violência doméstica e familiar. Esta medida é vista como uma forma de proporcionar segurança e estabilidade para as vítimas, permitindo que elas mantenham suas atividades profissionais em um ambiente protegido.

Conforme a legislação vigente, os juízes já têm a prerrogativa de assegurar que mulheres em situação de violência doméstica possam se afastar de seus locais de trabalho, mantendo o vínculo empregatício por até seis meses. Esta disposição é crucial para proteger as vítimas durante períodos de maior vulnerabilidade, evitando que elas precisem se expor a potenciais agressores em seus trajetos diários ao trabalho.

Principais mudanças propostas

A nova proposta legislativa sugere que, quando necessário, os juízes garantam a manutenção do emprego das vítimas por até um ano. Essa manutenção pode ocorrer em locais alternativos onde não haja risco para a integridade da mulher, ou, caso isso não seja viável, que seja permitido o regime de trabalho remoto.

A deputada Lêda Borges (PSDB-GO), responsável pela proposta, argumenta que a redação atual da lei é positiva, uma vez que reconhece o perigo que muitas mulheres enfrentam ao se deslocarem para o trabalho. "Apesar de louvável, a lei atual levanta várias questões jurídicas. Por exemplo, o empregador pode transferir a empregada para outro local de trabalho seguro? Ou o empregador pode decidir pela manutenção do trabalho remoto?" questiona a parlamentar.

Análise e avaliação

Para a deputada Lêda Borges, é essencial que a lei seja modificada para permitir que o juiz analise cada caso de forma individual, implementando medidas protetivas que melhor se adaptem às necessidades específicas das vítimas, seja através do trabalho remoto ou da transferência para outro local seguro.

O Projeto de Lei 2837/23 será examinado de forma conclusiva pelas comissões de Trabalho; de Defesa dos Direitos da Mulher; e de Constituição, Justiça e Cidadania. Para que a proposta se torne lei, ela precisa ser aprovada tanto pela Câmara dos Deputados quanto pelo Senado.
