O Projeto de Lei 2331/22, em análise na Câmara dos Deputados, regulamenta os serviços de vídeo sob demanda (VoD), obrigando as empresas a recolher a Contribuição para o Desenvolvimento da Indústria Cinematográfica Nacional (Condecine). A Condecine é um tributo cuja arrecadação destina-se ao fomento do cinema e do audiovisual nacionais.

O VoD é um termo geral para várias modalidades de serviços, como o streaming (Netflix, por exemplo) e o aluguel ou venda de conteúdos específicos (como a loja de filmes do YouTube).

Pelo texto, a Condecine será anual com alíquota progressiva, conforme as seguintes regras:

Empresas com faturamento acima de R$ 96 milhões pagarão alíquota de 3%;Empresas com faturamento entre R$ 4,8 milhões e R$ 96 milhões recolherão 1,5%;Serviços com faturamento inferior a R$ 4,8 milhões terão a alíquota zerada; eO tributo será reduzido pela metade quando 50% do conteúdo do catálogo do serviço for nacional.

Para calcular o imposto, as empresas deverão separar as quantias obtidas com os serviços de streaming do lucro que ganharam com outros serviços, como publicidade, conteúdos esportivos, entre outros.

Alguns serviços estarão livres do imposto, como os conteúdos jornalísticos e os conteúdos audiovisuais sob demanda estritamente educacionais.

A proposta estabelece ainda uma série de outras medidas, como a ampliação das competências da Ancine e cotas para as produtoras brasileiras independentes. As principais são:

Os serviços de streaming terão que disponibilizar permanentemente no catálogo quantidades mínimas de conteúdos audiovisuais brasileiros;A oferta será baseada no tamanho do catálogo (por exemplo, para streamings com dois mil produtos, pelo menos 100 terão que ser brasileiros);As plataformas também terão que apresentar à Ancine a documentação relativa ao faturamento e a listagem de conteúdos audiovisuais brasileiros;O fabricante de equipamentos de televisão deve evitar condutas lesivas à concorrência na oferta de conteúdos em seu sistema operacional; eOs provedores de serviço de VoD que descumprirem as obrigações estarão sujeitos a advertência e multa, inclusive diária, a serem determinadas pela Ancine.

O projeto será analisado em caráter conclusivo pelas comissões de Cultura; de Comunicação; de Finanças e Tributação; e de Constituição e Justiça e de Cidadania. Se houver mudanças no texto, ele retornará ao Senado para mais uma rodada de votação. Se não houver, poderá ir para sanção presidencial.

A Câmara analisa ainda outra proposta com o mesmo objetivo de regulamentar o VoD no Brasil. O PL 8889/17 está pronto para análise do Plenário. O relator, deputado André Figueiredo (PDT-CE), apresentou um parecer preliminar, cuja votação depende de acordo entre os partidos.
